Abstrak

This study is motivated by inconsistencies in the application of the principles of transparency, openness, and accountability in the selection process for Constitutional Court justices in Indonesia, which may affect judicial independence. It aims to examine the implementation of transparency and openness principles, analyze the authority of the House of Representatives (DPR) from institutional and checks-and-balances perspectives, and formulate an ideal regulatory model for the selection mechanism of constitutional justices. The research adopts a normative juridical method using statutory, conceptual, and analytical approaches based on a literature review. The findings reveal a gap between legal norms and selection practices, fragmented procedures across institutions, and the potential politicization of authority that undermines institutional accountability. The study concludes that standardizing selection mechanisms grounded in substantive transparency, public participation, and strengthened procedural regulation is necessary to safeguard the integrity and independence of the Constitutional Court.
