Abstract

Penelitian ini dilatarbelakangi oleh disharmonisasi antara rezim investasi nasional dan prinsip Provinsi Konservasi di Papua Barat yang menyebabkan ketidakpastian hukum, konflik hak ulayat, dan belum optimalnya peran masyarakat hukum adat (MHA) dalam investasi berkelanjutan. Penelitian ini bertujuan merekonstruksi regulasi investasi melalui penguatan pengakuan hak MHA, analisis praktik terbaik internasional, redefinisi MHA sebagai mitra strategis investasi, serta perumusan model kebijakan investasi berbasis konservasi. Penelitian menggunakan metode hukum normatif dengan pendekatan perundang-undangan, konseptual, komparatif, dan kasus. Hasil penelitian menunjukkan bahwa resiliensi investasi dibangun melalui keadilan distributif, keberlanjutan ekologis, dan kepastian hukum; praktik Maori dan First Nations membuktikan efektivitas kemitraan adat-industri; serta menghasilkan model Tata Kelola Investasi Masyarakat Adat Berbasis Konservasi yang mengintegrasikan konservasi, pluralisme hukum, hak ulayat, dan pembangunan ekonomi. Model ini memperkuat legitimasi sosial, meningkatkan kepastian hukum, dan mendorong daya saing investasi berkelanjutan di Papua Barat.
